been seeing this asked a bunch since the NY/CA bans. i know it uses mystery coins and that card battle thing instead of sweeps coins, but still curious how that changes the legal angle. why is card crush legal in california but sweeps are not? It seems like both models still use “duel currency” so what am I missing here?
It technically shouldn’t be, but yay loopholes. As with all the sweeps models they operate in a very cat and mouse game’y way taking advantage of grey areas. This results in doing a little bit of “Hmm the law mentioned two types of coins/currency but it didn’t specifically say “cards” and cards aren’t a currency, so therefore until they make a new all-inclusive statement about cards we’re legal.” It is simply a way of adapting to take advantage of the neglected market. So its back to grey area legality, for now until the cat catches up once again. And the cat will catch up, to all of us eventually.
The end goal is only state-run lotteries and state regulated sites/casinos which are heavily taxed to have all of the gambling. Thats the source of every single lawsuit and crackdown in the country. Casinos agree to levels of state taxation no other industry puts up with, in exchange for exclusivity. They’re tired of losing their exclusivity to things people can do at home in their pajamas.

That makes sense. I appreciate the detailed answer @backinthejox ! So its basically the same grey area argument, just with cards instead of coins and thats how they get around being “duel currency”. Wonder how long until they close that loophole too.
